TERMS OF SERVICE

Please read these Terms and Conditions carefully, as they contain important information regarding your legal rights, remedies, and obligations, and in using this website, you are deemed to have read and agreed to the following Terms and Conditions.   The Rise Cycle Co. website allows users to receive information about Rise Cycle Co., as well as book classes, cancel, and pay for services and products offered at Rise Cycle Co. facilities.

COVID-19 POLICY

An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. By visiting Rise Cycle Co., you voluntarily assume all risks related to exposure to COVID-19. By booking a class and entering the facility you agree to follow all of the health & safety protocols set forth by Rise Cycle Co. and failure to do so will result in you being asked to leave the facility. You agree that you will not enter the Rise Cycle Co. facilities or take classes if:

• You have been diagnosed with or suspected of having COVID-19.

• You have a fever, cough, or shortness of breath.

• You have 2 or more COVID-19 symptoms (fever, chills, headache, loss of taste/smell, diarrhea, muscle pain, sore throat, vomiting, cough, or shortness of breath).

• You have had close contact with a person with COVID-19 in the past 14 days.

WHAT TO EXPECT IN CLASSES AT RISE CYCLE CO.

Rise Cycle Co. conducts full-body, high intensity, choreographed, cardio classes on a stationary bicycle. These indoor cycling classes also use a set of light dumbbells to incorporate drills targeting your upper body, arms, obliques and core. Rise Cycle Co. classes are taught with high intensity, but you are responsible for taking the class at your own pace according to your health, skill and comfort level. Rise Cycle Co. bikes are self-adjusting, so you control your intensity. Once class begins, we ride in the dark and utilize intermittent colored lighting that flashes and strobes. Please do not ride if you are sensitive to lights and lighting changes or have any medical conditions that can be triggered by lights and sounds. Please be aware that temperatures may reach 85° in certain classes. Music will be played at loud volumes, sometimes over 80 decibels. Music will be played which may contain explicit language. If you are sensitive to heat, lighting changes, loud music, or explicit music, please check with our front desk staff to find the right instructor to meet your needs. If you are sensitive to loud music, please ask the front desk for a pair of complimentary foam earplugs. Be aware that riding an indoor cycle with little to no resistance can be harmful and result in injury.  Please keep one to two full turns of resistance on the bike at all times. Please note that riders must be 4’10” at the minimum to participate in classes at Rise Cycle Co. Should you need assistance, you are responsible for asking one of our skilled team members to properly fit you to your bike, explain how to manage your resistance, and how to clip in and out of the pedals. The bikes require cycling shoes with cleats. You may bring your own or rent shoes from Rise Cycle Co. Additionally, we ask that you remove your indoor cycling shoes and walk with caution in Rise Cycle Co. facilities. Cycling shoes are not made to walk in and can easily break or cause you to slip if not careful. Rise Cycle Co. also offers activities, parties and events for groups, private parties, charity rides and more. Please note that Rise Cycle Co. reserves the right to refuse service to anyone.

BOOKING POLICY

To book a class at Rise Cycle Co., you must have a valid class credit or membership to reserve a bike. To buy an individual class credit or membership, you can either sign up on risecycleco.com or the Rise Cycle Co. app by using your email and creating a password or if you are already registered, click login to buy a class credit or membership and make your reservation.

CANCELLATION POLICIES

To cancel a Rise Cycle Co. class you reserved using a class credit, you may do so without penalty by canceling online or via the mobile app NO LATER THAN 12 hours before your scheduled class. If your bike is canceled by this time, your class credit will be returned to your account. If you cancel your bike within 12 hours of your scheduled class, the class credit will be forfeited.   To cancel a Rise Cycle Co. class you reserved using an unlimited membership, you may do so without penalty by canceling online or via the mobile app, NO LATER THAN 12 hours before your scheduled class. If you cancel your bike within 12 hours of your scheduled class, you will be charged a $10 late cancel fee. Cancellations via voicemail, electronic mail (email), Facebook Messenger, Instagram, or text message will not be taken, and you will be charged. To dispute a fee, you must email info@risecycleco.com within 48 hours of the charge and refunds will be granted at the discretion of Rise Cycle Co. Rise Cycle Co. reserves the right to refund the charge to your account balance instead of credit card.

NO-SHOW POLICIES

Should you no-show to a Rise Cycle Co. class you reserved using a class credit, the class will be forfeited.   Should you no-show to a Rise Cycle Co. class you reserved using an unlimited membership, you will be charged a $20 no-show fee. To dispute a fee, you must email info@risecycleco.com within 48 hours of the charge and refunds will be granted at the discretion of Rise Cycle Co. Rise Cycle Co. reserves the right to refund the charge to your account balance instead of credit card. Please be aware that we release bikes three minutes before the start of class to those on the waitlist.

WAITLIST POLICY

If you book multiple classes or waitlist multiple classes, you are solely responsible for canceling your classes within the bounds of the cancellation policy. Rise Cycle Co. staff cannot be held responsible for accidental bookings by clients or double bookings or double waitlisted classes made by clients. Late cancel and no-show fees apply if you do not cancel within the bounds of the cancellation policy for double bookings. The system will auto-populate clients into class from the waitlist as other clients with confirmed spots cancel and bikes will be assigned as such. Riders added from the waitlist will be notified via email. Rise Cycle Co. staff will add walk-in, waitlisted clients in the order in which they were added to the waitlist by the computer system, top to bottom, and 3 minutes before the start of class. There is no waitlist priority given for early arrival.

CLASS CREDIT AND MEMBERSHIP RETURN AND EXCHANGE POLICY

All class credit and membership purchases are final. There are no refunds or exchanges on class credits or membership purchases.

RETAIL RETURN AND EXCHANGE POLICY

All physical retail and merchandise purchases, with the exception of cycling shoes, can be returned for Rise Cycle Co. credit only. Items must be returned within 7 days of purchase so long as they are unwashed, unworn, and are in the condition they were at time of purchase. Cycling shoe purchases are final sale.

AUTO-DEBITED CONTRACTS & UNLIMITED MEMBERSHIPS

The following terms and conditions apply if you are enrolled in an unlimited auto-debit contract:   I, the Client, authorize Rise Fit Co. LLC DBA Rise Cycle Co. to, on a recurring basis, automatically charge the debit or credit card account I specified, for monthly payments due on my unlimited auto-debit plan associated with my account.   I understand that Rise Cycle Co. will initiate transfers/charges pursuant to this authorization not to exceed the amount shown on my auto debit contract and/or in connection with cancellation fees according to the Rise Cycle Co. cancellation policy.  Rise Cycle Co. will initiate charges each month on the date my contract is set to renew.   Rise Cycle Co. may discontinue processing of recurring charges if Rise Cycle Co. is unable to secure funds from my debit or credit card I have authorized due to, but not limited to, insufficient or uncollected funds in the account or insufficient or inaccurate information I provided. FREEZING: You may freeze your membership at any time by emailing info@risecycleco.com with at least one week’s notice from freeze start. You may freeze your membership for a total of 90 days per year for a freeze fee of $5 per week, paid up front at time of freeze request. CANCELING: You may cancel any Rise Cycle Co. unlimited membership at any time after the contract minimum has been met. To cancel you must give 30-days written notice via email to info@risecycleco.com. Cancellations via voicemail, Facebook Messenger, Instagram, text message, or method other than emailing info@risecycleco.com will not be taken, and your membership will remain active and you will be charged monthly. You may cancel any Rise Cycle Co. unlimited membership without penalty for the following reasons: relocation or medical. If you’d like to cancel your Rise Cycle Co. unlimited membership for any other reason, you’ll be charged the remaining balance of your contract. Should you decide to purchase a new unlimited membership at a late date, you will be subject to the current rate of the membership. RELOCATION: If you relocate more than 25 miles away from any Rise Cycle Co., you may cancel your membership with proof of relocation, such as a utility bill, lease or deed to a house, or a letter from your human resources department stating you have been relocated to another region.   MEDICAL: If your doctor finds you medically unable to workout, we will just need a letter from your physician. They do NOT need to give us specifics, just their medical opinion that you are unable to work out for at least 4 months. You may deliver this note in-person to your studio’s manager or via email to your specific studio. Please include your most recent contact information in case we need to follow up with you. By continuing to use our services, you agree to the statements above regarding auto-debited contracts and unlimited memberships.

COOKIES

A cookie is a small text file that is sent to your browser from a website and stored on your computer’s hard drive. Cookies cannot read data from your hard disk or read cookie files that were created by other sites. This website uses cookies to obtain certain types of information, such as your username and password, to customize content areas or to analyze site activity and user behavior. Rise Cycle Co. reserves the right to use cookies in the future in conjunction with new content or expanded functionality.

PRIVACY STATEMENT

We at Rise Cycle Co. are committed to protecting your privacy. This privacy policy outlines the type of information we receive and collect when you use the features on our website as well as some of the steps that we take to safeguard the information. Please read this privacy policy before using this site or submitting your personal information. By using this site, you are accepting the practices described in this privacy policy. We do not sell your information to anyone.

COLLECTION OF INFORMATION

We collect personally identifiable information, such as names, phone numbers, postal addresses, email addresses, credit card information and etcetera when it is voluntarily submitted by our members and/or visitors. If you use this website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept sole responsibility for all activities that occur under your account or password. Registration of minors (ages 12-17) must be completed in person at one of our studios with a parent or legal guardian present. If we learn any personal information has been submitted to the website from a child under the age of 13, we will delete that information as quickly as reasonably possible. Rise Cycle Co. does not seek or share personal information from minors through this website.   Your personally identifiable information is kept secure. Only authorized employees, agents, and contractors who have agreed to keep information secure and confidential have access to this information. All emails, phone calls, mobile text messages, and newsletters from this site allow you to opt out of future marketing communication. We use industry-standard efforts to safeguard the confidentiality of your personal information, including the use of firewalls and secure sockets layer software where appropriate. We do not sell your information to anyone.   Rise Cycle Co. reserves the right to refuse, terminate accounts, remove or edit content, or cancel orders at their sole discretion.

INTELLECTUAL PROPERTY RIGHTS

“Rise Cycle Co.”, and the “R” winged logo and other graphics, logos, designs, page headers, button icons, scripts are service marks, trademarks, and/or trade dress of Rise Cycle Corporation DBA Rise Cycle Co. and may not be used by you for any other reason other than as expressly permitted by these terms. You have the right to view, electronically copy, and print in hard copy portions of this Website for the sole purpose of making class reservations or other personal use. Any other use of the materials on this Website without the prior written permission of Rise Fit Co. LLC DBA Rise Cycle Co. is strictly prohibited.

DISCLAIMERS

In no event shall Rise Fit Co. LLC DBA Rise Cycle Co., its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (1) errors, mistakes, or inaccuracies of content, (2) personal injury, illness or property damage, of any nature whatsoever, resulting from your access to and use of our website, (3) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (4) any interruption or cessation of transmission to or from our website, (5) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our site by any third party and/or (6) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Rise Cycle Co. website, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.   You specifically acknowledge that Rise Cycle Co. shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.   Rise Fit Co. LLC DBA Rise Cycle Co. may revise these terms and conditions by updating this posting. By using this Website, you agree to be bound by any such revisions and should therefore periodically visit this page to determine the then-current Terms and Conditions to which you are bound.

RELEASE OF LIABILITY & ASSUMPTION OF RISK

When you visit Rise Cycle Co. or send emails to us, you are communicating with us electronically, and therefore consent to receive communications from us electronically. We will communicate with you by email or by posting notices on this website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

I, the undersigned, desire to use Rise Fit Co. LLC (“Rise Cycle Co.”) facilities and equipment (the “Facilities and Equipment”) and participate in Rise Cycle Co. activities, classes and events (“Activities, Classes and Events”). In consideration for the right to use Rise Cycle Co. Facilities and Equipment and participate in Activities, Classes and Events, I voluntarily agree to this Release of Liability and Assumption of Risk (the “Release”) according to the following terms:

By signing up for and/or attending Rise Cycle Co. Activities, Classes and Events, and using Rise Cycle Co.’s premises, Facilities and Equipment, I hereby agree that there are certain inherent risks and dangers in indoor cycling and exercise and in using indoor cycling and exercise equipment in association with the classes and facilities. I am aware that riding an indoor cycle/stationary bicycle with little to no resistance can be harmful and result in injury. I will keep one to two full turns of resistance on the bike at all times.

I accept Rise Cycle Co.’s Facilities and Equipment “as is” and agree to use the Rise Cycle Co. Facilities and Equipment and participate in Activities, Classes and Events at my own risk. I understand the inherent risks involved in the use of Rise Cycle Co.’s Facilities and Equipment and participation in Activities, Classes and Events, and I expressly assume the risks of bodily injury, permanent disability or death. I agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by me in relation to the use of Facilities and Equipment and participating in the Activities, Classes and Events. I agree to follow all Rise Cycle Co. rules and regulations and to use Rise Cycle Co.’s Facilities and Equipment only as indicated and instructed by Rise Cycle Co.’s staff.

I represent I have no medical or physical condition which would prevent me from attending Rise Cycle Co. Activities, Classes and Events and/or using any of Rise Cycle Co.’s Facilities and Equipment and/or put me in any physical or medical danger, and have not been instructed by a physician not to do so. Prior to engaging in any of Rise Cycle Co. Activities, Classes and Events, I will discuss with my doctor or other healthcare provider to ensure that it is safe for me to do so. In addition, if in the opinion of Rise Cycle Co. staff, I would be at physical risk using Rise Cycle Co.’s Facilities and Equipment, I will be denied access to Rise Cycle Co. and its classes and facilities until I furnish Rise Cycle Co. with an opinion letter from my medical doctor, at my sole cost and expense, specifically addressing Rise Cycle Co.’s concerns, and stating that Rise Cycle Co.’s concerns are unfounded. If I am pregnant or become pregnant, I will receive clearance from my healthcare provider that it is safe for me to participate in Rise Cycle Co. Activities, Classes and Events.

I will not hold Rise Fit Co. LLC (“Rise Cycle Co.”) liable for any injury or damage to my person or property, arising from or related to (a) my use of Rise Cycle Co.’s Facilities and Equipment; (b) participation in Rise Cycle Co. Activities, Classes and Events; or (c) negligent acts or omissions of other patrons or guests of Rise Cycle Co. I forever release and discharge Rise Cycle Co. from all claims, demands and/or causes of action relating to any such injury or damage. Despite this Release, if I or anyone on my behalf makes a claim against Rise Cycle Co., I will indemnify Rise Cycle Co. from any and all litigation costs, attorney fees, damages or other expenses arising from such claim.

By visiting Rise Cycle Co., I voluntarily assume all risks related to exposure to COVID-19.

Prior to participating in any Rise Cycle Co. Activities, Classes and Events, I will inspect the Facilities and Equipment to be used. If I determine that anything related to the Facilities and Equipment or Activities, Classes and Events appears unsafe, I will immediately advise a Rise Cycle Co. employee of the condition and will not engage in the activity until the condition has been corrected.

I understand and acknowledge that Rise Cycle Co. may photograph and record me. I consent to the publishing and distribution of these photographs and recordings in connection with my participation in Rise Cycle Co. activities and my attendance at Rise Cycle Co. facilities. By acknowledging these terms, I agree and consent that Rise Cycle Co. may display these photographs and recordings through print media, their website, and social media channels including, but not limited to Facebook, Instagram, Tik Tok, and YouTube. Because of the nature of publication, the consent is irrevocable.

I consent to emergency medical care and/or transportation in order to obtain treatment in the event of an injury. This Release extends to any liability arising out of or in any way connecting with such emergency medical treatment, care and/or transportation.

I will not hold Rise Fit Co. LLC (“Rise Cycle Co.”) liable for lost or stolen personal property. I understand that it is my sole responsibility to ensure that my valuables are secured.

If any portion of this Release is declared invalid, I agree that all other terms and conditions of this Release shall remain effective. This Release shall be of perpetual duration and shall remain valid and enforceable.

I have read the above Release, understand its contents, and understand that by checking below, I have given up substantial rights.
